MIDDLETOWN, PENNSYLVANIA: August 13, 2007—Satnews Daily—The root of this lawsuit found the company King Controls asserting that KVH Industries was liable for royalties and King Controls sought an injunction against the sale of certain products as satellite switching capabilities present in KVH’s TracVision mobile satellite TV systems had infringed on a patent King Controls filed in 2000. KVH, on the other hand, contended that the technology in dispute has been developed prior to King Controls’ patent application. In fact, the technology was already in use in the industry, including KVH’s own products. KVH’s stipulation was such invalidated king Control’s patent claim.
In the U.S. District Court for the District of Minnesota, the jury ruled last Friday that KVH Industries was not liable for infringing King Control’s patent. The Jury found that claim 5 of U.S. Patent 6,864,846, which was the only claim at issue, was invalid due to the existence of prior art as well as the obviousness of the technology.
